These Terms & Conditions explain how bookings, quotes, vehicle repairs, servicing, diagnostics, payments and complaints are handled by Duke Street Motors.
By booking a vehicle with us, asking us to carry out work, using our website or contacting us about our services, you agree to these terms.
Nothing in these terms affects your statutory rights.

1. About us

2. Our services

We provide a range of garage services, which may include:

  • Vehicle servicing
  • Vehicle repairs
  • Diagnostics
  • MOT-related checks and repairs
  • Brakes

  • General maintenance

The exact work carried out will depend on the booking, inspection, diagnosis and agreement with the customer.

3. Bookings

You can contact us to request a booking by phone, website enquiry, email or any other contact method we make available.
A booking is not confirmed until we have agreed the date, time and type of work with you.
We will do our best to keep to agreed booking times, but times may change due to workload, parts availability, unexpected repair findings or other circumstances outside our control.
If you need to cancel or rearrange your booking, please contact us as soon as possible.

4. Quotes, estimates and pricing

We may provide a quote or estimate before work begins.
A quote is a fixed price for the agreed work, unless further issues are found or the scope of work changes.
An estimate is an approximate price based on the information available at the time. The final cost may be higher or lower depending on what is found during inspection, diagnosis or repair.
If extra work is needed, we will contact you before carrying out additional work where practical.
If no fixed price has been agreed, UK consumer guidance says a garage should charge a reasonable price for the work carried out. Citizens Advice also notes that an estimate can increase within reason if more time or parts are needed.

5. Diagnostics

Diagnostic work is charged for the time, equipment and expertise used to investigate a fault.
A diagnostic check may identify the likely cause of a problem, but some faults require further investigation. Modern vehicles can have linked electrical, mechanical and software-related issues, so a first diagnostic result may not always show the full extent of the repair needed.
Diagnostic fees are payable even if you decide not to proceed with the repair.

6. Authorising work

We will only carry out the work that has been agreed with you.
Authorisation may be given verbally, in writing, by email, by text message, through a booking system or by another clear form of communication.
By authorising work, you agree to pay for the agreed labour, parts, diagnostics and any other agreed charges.

7. Additional work

During servicing, diagnostics or repairs, we may find extra issues that were not visible or known when the booking was made.
If extra work is needed, we will explain the issue and provide an updated price or estimate where possible.
We will not normally carry out extra chargeable work without your agreement, except where it is needed for safety, to protect the vehicle from further damage, or where we have been unable to contact you and the work is minor or directly connected to the agreed repair.

8. Parts

We may use original equipment, aftermarket, reconditioned or other suitable parts depending on availability, customer preference, price and the type of repair.
We will fit parts that are suitable for the work being carried out. UK consumer guidance states that replacement parts fitted by a garage should be in good condition, suitable for the job and last a reasonable length of time.
Parts remain the property of Duke Street Motors until paid for in full.

9. Customer-supplied parts

In some cases, we may agree to fit parts supplied by the customer.
Where customer-supplied parts are used:

  • We are not responsible for the quality, condition, suitability or warranty of those parts.
  • Labour charges still apply.
  • If the part is faulty, incorrect or unsuitable, further labour charges may apply to remove, replace or investigate the issue.
  • Any warranty claim for the part must be handled directly between the customer and the supplier of that part.

We may refuse to fit customer-supplied parts if we believe they are unsafe, incorrect, poor quality or unsuitable for the vehicle.

10. Completion times

We will aim to complete work within the agreed timescale where one has been given.
Completion times may change due to parts delays, additional faults, technical complexity, supplier delays, staff availability or other circumstances outside our control.
If no completion date has been agreed, consumer guidance says work should be completed within a reasonable time.

11. Payment

Payment is due when the work is complete, unless agreed otherwise.
We may require payment before the vehicle is released.
Accepted payment methods may include cash, card, bank transfer or other payment options we make available.
Invoices must be paid in full. We reserve the right to withhold the vehicle until payment has been made for the work carried out. The AA notes that a garage may have a lien, meaning the right to keep the vehicle until payment is made for work completed.

12. Unpaid invoices

If an invoice remains unpaid, we may take steps to recover the amount owed.
This may include contacting you, adding reasonable recovery costs where allowed, using a debt recovery service or taking legal action.

13. Vehicle collection

Once we let you know your vehicle is ready, please collect it as soon as reasonably possible.
If a vehicle is not collected within a reasonable time after completion, we may charge storage fees. We will contact you before doing this where possible.
If a vehicle is left with us for a long period without payment, collection or contact, we may take further action in line with the law.

14. Vehicle condition and personal belongings

Please remove valuables and personal belongings from your vehicle before leaving it with us.
We are not responsible for loss or damage to personal items left in the vehicle unless caused by our negligence.
We may need to move, road test or inspect your vehicle as part of the agreed work.

15. Road testing

By leaving your vehicle with us, you allow us to carry out reasonable road tests where needed for diagnosis, repair checks, safety checks or quality control.
Road testing may be needed before or after repairs.

16. Warranties

Some parts and repairs may come with a warranty.
Warranty cover may vary depending on the part, supplier, manufacturer and type of repair.
Warranty does not usually cover:

  • Wear and tear
  • Misuse or neglect
  • Further faults not connected to the original repair
  • Damage caused by another garage or third party
  • Customer-supplied parts
  • Vehicles used in a way that places unusual strain on parts or repairs
  • Faults caused by ignoring further repair advice

Any warranty offered is in addition to your statutory rights. The Consumer Rights Act 2015 sets out consumer rights for goods and services, including that goods should be of satisfactory quality, fit for purpose and as described.

17. Advisories and recommendations

During inspection, servicing or repair, we may identify advisory items or recommended work.
Advisories are based on what we can see, test or reasonably identify at the time.
It is the customer’s responsibility to decide if they want to proceed with advisory or recommended work.
If you choose not to proceed with recommended repairs, we are not responsible for problems that arise from the issue being left unresolved.

18. Safety-related issues

If we believe a vehicle is unsafe to drive, we will explain the concern to you.
We may advise that the vehicle should not be driven until repair work is completed.
If you choose to drive the vehicle against our advice, you do so at your own risk.

19. MOT-related work

We may carry out MOT-related repairs, pre-MOT checks or work following an MOT failure.
An MOT result is based on the condition of the vehicle at the time of testing. Passing an MOT does not mean the vehicle will remain free from faults after the test.
Repairs carried out after an MOT failure do not guarantee a pass if other issues are later identified during testing.

The information on our website is provided for general guidance only.
We aim to keep website information accurate, but services, prices, availability and details may change.
Website content should not be treated as technical advice for a specific vehicle. Please contact us directly for advice about your vehicle.

21. Limitation of liability

We are responsible for losses caused by our negligence, breach of contract or failure to meet legal duties.
We are not responsible for:

  • Existing faults or damage not caused by us
  • Problems caused by customer-supplied parts
  • Losses caused by inaccurate information provided by the customer
  • Indirect losses not reasonably foreseeable
  • Delays caused by parts suppliers, manufacturers or circumstances outside our control
  • Further faults that were not reasonably identifiable during the original work

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.

22. Customer responsibilities

Customers are responsible for:

  • Providing accurate contact and vehicle information
  • Telling us about known faults or previous repairs where relevant
  • Authorising work clearly
  • Paying invoices when due
  • Collecting the vehicle within a reasonable time
  • Following safety advice and repair recommendations
  • Keeping contact details up to date while the vehicle is with us

23. Complaints policy

We want customers to be happy with the service they receive from Duke Street Motors.

What happens next

We will review your complaint and may ask for more information.
Where the complaint relates to repair work, we may need to inspect the vehicle before making a decision. Please do not arrange further repairs elsewhere before giving us a reasonable opportunity to inspect the issue, as this may make it harder to assess the complaint fairly.
We will aim to respond as soon as reasonably possible.
Depending on the issue, we may offer one or more of the following:

  • An explanation of the work carried out
  • A further inspection
  • A repair or correction where appropriate
  • A revised invoice where an error has been made
  • Another reasonable solution based on the circumstances

If the complaint is not resolved

If we cannot resolve the complaint between us, you may wish to seek independent advice from Citizens Advice, Trading Standards or another relevant consumer support service.

24. Data protection

We collect and use personal information in line with our Privacy Policy. This may include your name, contact details, vehicle information, booking details, invoices and service records.

25. Changes to these terms

We may update these Terms & Conditions from time to time.
The latest version will be published on our website.

26. Governing law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales, unless another process is agreed or required by law.
